By navigating through or accessing this site, you acknowledge and agree to the disclaimers, terms and conditions that are set forth below. Please read the following carefully:

Our site is accessible worldwide, but we do not provide products or services to all regions in the world. Gadzuk.com reserves the right to limit, at its own discretion, the sale or provision of any quantity of product or service to any person or geographical region it so desires. All offers for any product or service made in or through this site are void where prohibited. 

 

Refunds  

 
Refunds are available in the event that the purchased activity can no longer be offered by Gadzuk.com and its affiliates. If approved, all refunds will be issued to the purchaser of the reservation or gift certificate. As your sales agent, Gadzuk.com is obligated to uphold pre-existing vendor policies on your behalf. This may lead to ADDITIONAL penalties or forfeitures as stated in OUR AFFILIATES’  Terms and Conditions. By accepting our Terms and Conditions, you are accepting Gadzuk.com as your sales agent.

 

Properly cancelled reservations may be rescheduled or exchanged for a Gift Certificate, which is valid for 2 years from the date of original purchase. Refund requests for cancelled reservations will be honored, if the cancellation(s) meet the requirement for approval, as set forth by our  Terms and Conditions.

 

Events can be cancelled for various reasons, including inclement weather, unscheduled equipment maintenance, emergency situations, or any other circumstance that is unforeseen to Gadzuk.com, which would prevent our vendor from carrying out their scheduled service. In the event of inclement weather, most vendors will reschedule the experience if they are forced to cancel.

 

To request a refund, send an email to support@Gadzuk.com containing the certificate or reservation number, purchaser name, address, telephone number and any additional information pertaining to the request. You can expect a response within (10) business days.

 

Agents are available to accept your phone calls seven (7) days a week at our Corporate Headquarters.  Hours of operation may vary from season to season, but agents are usually available during daytime hours that are convenient for customers calling from the North American region.

 

Gadzuk.com Service Providers

 
Gadzuk.com boasts a vast, nationwide network of providers, whose combined services allows us to cater to Americans located in regions all across the country. If there is a change in our affiliated vendor list, or if a venue or location is withdrawn from the Gadzuk.com network for any reason, comparable alternatives will be offered to the customer who made the reservation for an event at such a venue. In the event of such a case, the recipient(s) will be able to exchange their Gadzuk.com Certificate for a difference Gadzuk.com Experience of equal monetary value. Gadzuk.com Service Providers and our affiliates have their own terms and conditions, which Gadzuk.com agrees to on your behalf, acting as your sales agent. By accepting our Terms and Conditions, please be aware that you are giving Gadzuk.com permission to act as your sales agent. Participants may also be required to sign an acceptance form or a waiver by the Gadzuk.com Service Provider and will be informed of this when they redeem their Gadzuk.com Certificate or by the Service Provider at the time of the Gadzuk.com Experience.  
 

Gadzuk.com Information & Promotional Material  

 
Gadzuk.com works diligently to keep all information in our database, regarding all advertised Gadzuk.com Experiences, as accurate and up-to-date as possible. The stated details of a Gadzuk.com Experience may change without notice. Please allow Gadzuk.com sufficient time to correct such inaccuracies, as they cannot be immediately updated on our website or outdated promotional materials.

 

The pictures displayed on the Gadzuk.com website, or any other Gadzuk.com promotional material, is provided for the implicit purpose of illustrating the details of the Gadzuk.com Experience to any and all potential customers and may not accurately reflect the details of a particular Gadzuk.com Experience.

The duration of each Gadzuk.com Experience is approximated for ideal circumstances. Details involving the number of serviceable participants for a single booking, or any eventualities that may lead to a customer having a wait time, are entirely contingent on the operations of the Service Provider. Service Providers in the Gadzuk.com Network have their own set of policies and procedures, which are independent from the policies and procedures set forth by Gadzuk.com. These policies and procedures are outside our power to control or alter in any way. Gadzuk.com will provide itineraries as a guide whenever possible.

 

Gadzuk.com Experience Requirements

 
It is the responsibility of the Gadzuk.com participant to comply with all necessary requirements of the Gadzuk.com Experience, as set forth by Gadzuk.com or any enacted Service Provider. Some of the experiences offered by Gadzuk.com may be restricted to individuals who meet certain safety requirements, including but not limited to age, health, physical ability, height, and weight. Any description of a Gadzuk.com Experience will explain, as accurately as possible, the limitations or requirements relating to each Gadzuk.com Experience. Participants may be liable for cancellation costs, if the cancellation is a result of the customer failing to meet the stated safety requirements. Gadzuk.com Gift Credits

 
Gadzuk.com Credits remain valid for a period of up to two years.  Credits that are cashed in for a specific Gadzuk.com Experience may be exchanged prior to booking for another experience. Gadzuk.com reserves the right to impose an administration fee in such an event. 

 

The Gadzuk.com Certificate has a Certification Number and Redemption Reference Number, which allows our customer service agents to quickly reference a customer’s transaction information and easily confirm the customer’s identity.Gadzuk.com Certificates are non-replaceable and must be presented, intact, on the day of the Gadzuk.com Experience.Gadzuk.com Certificates can be redeemed for service within the allotted time frame, ranging from the Issue Date to the Expiration Date printed on the back of the Gadzuk.com Certificate.

Availability  

 
All Gadzuk.com Experiences should be booked a minimum of 3 days in advance, in order to assure a strong likelihood of availability. We recommend further advance notice, when booking for weekend or holiday periods. This is because there are certain seasonal or holiday events that become unavailable earlier than others. If you need assurance that your preferred time and date are available for a particular weekend or holiday, it is highly recommended that you call at least a month in advance in order to secure your desired schedule.

 

Although we do make every effort to meet all of our customers’ needs, Gadzuk.com cannot guarantee that we will be able to provide a Gadzuk.com Experience on a customer’s desired date and time. Participants will receive a confirmation e-mail of their booking transaction through Gadzuk.com. Please do not make any travel or other Gadzuk.com Experience related arrangements until your Gadzuk.com booking has been confirmed. 

 

Gadzuk.com reserves the right to substitute certain elements of the Gadzuk.com experience, should these elements become unavailable due to circumstances outside our control.

Gadzuk.com reserves the right to cancel an adventure experience based on the availability of our Service Provider(s). In the event of such a cancelation, your activity will be rescheduled and you will be contacted by a Customer Service Representative in order to do so.

 

Cancellations

 

If you are unable to make your appointment for any reason, you must contact us about the cancellation via email to:support@Gadzuk.com within 72 hours of your scheduled appointment time.

 

You must provide the certificate or reservation number or purchaser information along with date and time of appointment. This entitles you to reschedule your appointment or transfer the credit to another service or location or receive a gift certificate for the value of the original purchase. If you do not send notice of your cancellation request according to set guidelines, you will automatically forfeit the value of the certificate or reservation and your appointment will not be rescheduled.

Your Right To Privacy  

 
If you wish to purchase products or services described in this site, you may be prompted to supply certain information, including credit card or other payment information. By providing such information, you are certifying that the information given is valid, complete and up-to-date. By agreeing to any Gadzuk.com purchase, you are also agreeing to pay all charges incurred by users of your credit card or other payment mechanism at the prices in effect, when such a charge was incurred (including shipping and handling charges). You are responsible for paying any taxes applicable on such a purchase.

 

Data about the activity of visitors to this site is automatically provided to Gadzuk.comGadzuk.com may use or disclose it’s users’ information for such purposes as customer demographic studies and other such purposes that do not reveal the customer’s identity. Email addresses, postal addresses, telephone numbers and other personal information about our customers is provided to Gadzuk.com only when voluntarily submitted or posted to this site. Gadzuk.com may use such personally identifying information provided by you to send communications to you regarding orders placed. Gadzuk.com may also use this information to give advanced notice of upcoming events and new products and services. Gadzuk.com reserves the right to refuse any order for any reason. Orders may be delayed or canceled if Gadzuk.com is not given completely accurate information and/or is unable to contact the person who has placed the order and/or is the primary cardholder for the order.

Other Terms & Conditions  

 
Gadzuk.com is independently owned and operated. Gadzuk.com Service Providers are individually responsible for their health and safety standards and operating practices. Gadzuk.com, therefore, makes no guarantees as to the consistency or efficacy of any particular Service Providers.

 

 
Gadzuk.com accepts no responsibility and shall not be liable for any loss, injury, claim, cost, damage, or any special, exemplary, punitive, indirect, incidental, or consequential damages of any kind, whether based in contract, tort, strict liability or otherwise which arises out of or is in any way connected with (a) the use and redemption of this certificate or (b) the performance or nonperformance by any Service Providers even if all parties have been advised of the possibility of damages.

 

Gadzuk.com shall not be liable, under any circumstance, for any delay or failure, which relates to vendor performance.Gadzuk.com is not liable for any delay or failure on the vendor’s behalf to perform, be it a result from a random act of nature or any disruptive force outside our ability to control.

 

By exchanging the Gadzuk.com Certificate or ticket, the participant accepts all Terms and Conditions stated at the time of service and releases Gadzuk.com from any and all liability for any loss, injury, claim, cost or damage, directly or indirectly, connected with the chosen Gadzuk.com Experience. If any provision of this Agreement is found to be invalid or unenforceable in any respect, the validity and enforceability of the remaining provisions shall not be affected. All clerical errors are subject to correction. Failure on the part of Gadzuk.com to enforce, at any time, any of the provisions of the Agreement, shall not be construed by the customer, as a waiver of such provisions or as a waiver for our right to enforce them.

 

The purchaser may not assign any rights under this Agreement without the written consent of Gadzuk.com. The purchaser shall have no right to set off amounts due with respect to one transaction for claims under any other transaction with Gadzuk.com  
 
Any disputes arising under this Agreement shall be resolved, if not sooner settled, by a state or federal court of competent jurisdiction located in Georgia, U.S.A., and the Purchaser hereby irrevocably submits to the exclusive jurisdiction of such courts. These Terms and Conditions are subject to change without notice.  

 

DEFINITIONS  

 
Purchaser - The person who completes the financial transaction with Gadzuk.com. An electronic receipt will be provided to the purchaser at the time of the transaction.  
 
Service Provider - Any corporation, individual, or group of individuals, designated by Gadzuk.com engaged in the provision of Gadzuk.com Experiences or related materials.  
 
Recipient - The person or persons designated to participate in the Gadzuk.com Experience by the purchaser.  
 
Participant - The person who participates in the Gadzuk.com Experience.
